CITIZEN’S CHARTER 2011
INTRODUCTION
This Commission is a quasi-judicial authority constituted by the Lt. Governor of Government of National Capital Territory of Delhi vid Notification dated 20.04.1993 as a permanent body in pursuance of the judgment of the Hon’ble Supreme Court of India dated 16th Novemeber 1992 in the CWP No.930 of 1990 ( Indira Sawhney and Others. Vs. Union of India and Others.)
CONSTITUTION OF THE COMMISSION
The Commission consists of five persons as under :-
- A Chairperson, who is or has been a Judge of the High Court or the Supreme Court or a retired or serving Civil Servant or a prominent public figure.
- Chairperson, Delhi Social Welfare Advisory Board ( Member-Ex-Officio).
- Two non-official Members, who have special knowledge in matters relating to backward classes, to be nominated by the Government.
- Member-Secretary of the Commission.
FUNCTIONS
The main function of the Commission is to entertain, examine and recommend upon requests for inclusion and complaints of over inclusion and under-inclusion in the list of Other Backward Classes. Further, to tender such advice to the Government, as it deems appropriate.
POWERS OF THE COMMISSION
- To summon and enforce the attendance of any person from any part of India and examine him/ her on oath.
- Requiring the discovery and production of any documents.
- To receive evidence on affidavit (s);
- To requisition any public record or copy thereof from any court or office.
- To issue summons for examination of witnesses and documents and
- Any other matter, which may be prescribed.
ACHIEVEMENTS
This Commission has so far issued four reports. In its 1st report, the Commission identified 53(fifty-three) Castes for inclusion in the OBCs list of GNCT of Delhi vide Notification dated 20.01.1995. In it’s 2nd report, the Commission identified one more caste namely “Jat” for inclusion in the OBCs list of Govt. of NCT of Delhi vide Notification dated 31.05.2000. This Commission in it’s 3rd report and 4th report identified 10 more castes for the inclusion in the OBCs list of Govt. of NCT of Delhi vide Notification dated 05.02.2004. The Commission in it’s 3rd report has also identified one caste namely “Rauniyar” and one caste namely “Vaishnav Swami” alongwith the existing caste “Bairagi” for inclusion in the OBCs list of GNCT of Delhi. The proposal was not accepted by the Government of India earlier and but later with the approval of the Government of India, Ministry of Social Justice and Empowerment conveyed vide letter No.12011/5/2002-BCC dated 26th August, 2005, a Notification dated 14.11.2005 was issued.
PROCEDURE FOR OBTAINING SERVICES
- If any class of citizen feels that their caste / community should be included in OBCs list of Delhi, the applicant will have to make a request for such inclusion along with documentary and supporting evidence (s)/ material (s) regarding social, economic and educational status either to the Member- Secretary or the Chairman of the Commission.
- For the purpose of obtaining OBC certificate, citizens belonging to the OBC category to the OBC category may approach their SDMs of the District concerned.
